SUMMARY: Race Day Wheels is not liable for the safety of any athlete using the rental wheel or wheels during the rental period or thereafter. The athlete/customer renting the wheel or wheel set assumes all responsibility for their safety. If you choose to purchase our insurance ($25 per rental), you will be covered against damage (to the wheel or wheel set only) incurred during riding or race accidents that occur during triathlon events. This insurance does not cover stolen or lost wheels. You are responsible to return the rental wheels in the same condition in which they were rented to you (except for normal wear and tear).
“I (You) understand that by renting a wheelset, I (You) may receive communication from Race Day Wheels or an Authorized Third Party asking for feedback on my (your) experience and acknowledge that I (you) may opt out at any time with the originating contactor.”
RACE DAY WHEELS TERMS AND CONDITIONS:
Race Day Wheels is not liable for the safety of any athlete using the rental wheel or wheels during the rental period or thereafter. The athlete/customer renting the wheel or wheel set assumes all responsibility for their safety.
INSURANCE ($25 per rental): Will cover damage in race accidents. Does NOT cover stolen or lost wheels. If insurance is purchased, you will be charged $25 additional per rental.
RETURN CONDITION: You are responsible to return the rental wheels in the same condition in which they were rented to you (except for normal wear and tear).
Liability Waiver: In consideration of the acceptance of this rental of the above wheels by Race Day Wheels and Race Day Company Inc on this date, the undersigned participant(s) and (if participant is under 18 years of age) parent or guardian, intending to be legally bound, do hereby for ourselves, our heirs, executors and administrators, waive, release and forever discharge any and all rights to claims for damages which I may have or which hereafter accrue to me, against any and all persons, organizations and legal entitles affiliated with such rental of the wheels, and specifically to Race Day Wheels and Race Day Company Inc, together with their representative officers, agents, representatives, employees, successors, estates, assigns and or sponsors, for any and all damages which may be sustained or suffered by me in connection with the use of the wheels as provided by Race Day Wheels in, and/or arising out of our traveling to, participation in and returning from said event. I hereby agree and I understand that cycling is an arduous athletic event and herby certify that I am properly conditioned to participate, and, that I am fully knowledgeable of the use of carbon aerodynamic wheel sets as they relate to acute handing needs, and speed increases during an event and training. Moreover, I am completely aware of stability issues associated with cross winds, and wind gusts, which could affect me during my use of any wheels provided by Race Day Wheels and Race Day Company Inc and hold Race Day Wheels and Race Day Company Inc completely harmless for any incident incurred or caused by me during the rental period. The undersigned is acknowledging that they intend to be the single user of these wheels during the said event; any transfer of this rental agreement to a person other than the undersigned is not permitted.
BY INITIALING THESE TERMS AND CONDITIONS, YOU HEREBY AGREE TO THE ABOVE TERMS AND FURTHER AUTHORIZE RACE RAY COMPANY TO CHARGE YOUR CREDIT CARD FOR THE RETAIL DEPOSIT PRICE OF THE WHEEL OR WHEEL-SET YOU ARE RENTING, LESS THE RENTAL FEE, IF THE WHEEL OR WHEEL-SET IS NOT RETURNED, AND AGREE TO PAY FOR ANY AND ALL DAMAGE INCURRED (above normal wear and tear) WHILE RENTING THE WHEELS, IF YOU DID NOT PURCHASE THE OPTIONAL INSURANCE.
